Introduction

CannyCask Limited is a company registered in Scotland that facilitates the purchase, ownership, verification and transfer of whisky casks stored within HMRC-regulated bonded warehouses.

CannyCask operates a digital infrastructure platform connecting bonded warehouse custody records with verified ownership, provenance and settlement processes.

By using the CannyCask website, platform or services, you agree to these Terms & Conditions.

Definitions

"CannyCask" means CannyCask Limited.

"Customer" means the individual or entity purchasing, owning or transferring a whisky cask through the CannyCask platform.

"Cask" means a physical whisky cask stored within a bonded warehouse.

"Bonded Warehouse" means an HMRC-regulated bonded warehouse operated by an authorised warehousekeeper.

"Warehousekeeper" means the legal custodian responsible for maintaining bonded warehouse records.

"DAV VERIFIED®" means a cask that has successfully completed Dual Approval Verification.

"DAV" means Dual Approval Verification, the process whereby both CannyCask and the bonded warehouse independently verify the same cask provenance record.

"DDO" means Digital Delivery Order, the digital instruction used to coordinate ownership transfers through bonded warehouse records.

Platform Role

CannyCask provides verification, ownership, provenance and settlement infrastructure.

CannyCask does not operate bonded warehouses and does not physically store whisky casks.

Physical custody of casks remains with the bonded warehouse and warehousekeeper.

The bonded warehouse register remains the authoritative record of custody and ownership.

DAV VERIFIED® Casks

Only DAV VERIFIED® casks may be offered through the CannyCask platform.

DAV VERIFIED® indicates that both CannyCask and the bonded warehouse have independently verified the same cask provenance record.

DAV VERIFIED® does not replace bonded warehouse custody records.

The bonded warehouse register remains the authoritative source of truth.

Customer Onboarding

Customers must complete any applicable identity verification, compliance and onboarding requirements before acquiring ownership of a cask.

CannyCask reserves the right to request additional information where required to satisfy legal, regulatory or operational obligations.

Failure to provide requested information may result in suspension or cancellation of a transaction.

Purchases

All purchases are subject to:

1. Successful customer onboarding;
2. Successful compliance verification;
3. Cask availability;
4. Successful payment settlement; and
5. Successful ownership registration within the bonded warehouse.

A transaction is not considered complete until ownership registration has been successfully completed.

Ownership & Custody

Ownership of a cask is recorded through the bonded warehouse ownership register.

Digital records maintained by CannyCask reflect, verify and support bonded warehouse ownership records but do not replace them.

The warehousekeeper remains the legal custodian of the cask while it remains in bonded storage.

Digital Delivery Orders (DDOs)

Ownership transfers are coordinated using Digital Delivery Orders.

A DDO does not replace the bonded warehouse register.

Ownership transfers are only completed when recognised and recorded within the bonded warehouse records.

Pricing & Payment

Prices displayed on the platform may change without notice.

Payment may be accepted through approved payment methods offered by CannyCask.

Any applicable fees, charges or taxes remain the responsibility of the customer unless stated otherwise.

Cancellation & Refunds

Consumer customers may have statutory cancellation rights under applicable consumer protection legislation.

Cancellation and refund rights are governed by the CannyCask Cancellation & Refund Policy.

Intellectual Property

CannyCask®, Digital Keeper of the Cask®, DAV VERIFIED® and associated branding, logos, content and materials are the intellectual property of CannyCask Limited.

Unauthorised use, reproduction or distribution is prohibited.

Certain verification, provenance and settlement processes utilised by CannyCask may be protected by patent applications and other intellectual property rights.

Limitation of Liability

CannyCask shall not be liable for:

1. Actions or omissions of bonded warehouses;
2. Delays caused by warehouse operations;
3. Regulatory actions affecting bonded warehouses;
4. Market value fluctuations of whisky casks;
5. Indirect or consequential losses.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

Website Availability

CannyCask may modify, suspend or withdraw any part of the platform, website or services at any time.

CannyCask does not guarantee uninterrupted platform availability.

Third-Party Services

The platform may integrate with third-party providers, bonded warehouses and service partners.

CannyCask is not responsible for third-party systems outside its reasonable control.

Governing Law

These Terms & Conditions shall be governed by the laws of Scotland.

Any dispute arising from the use of the website, platform or services shall be subject to the exclusive jurisdiction of the Scottish courts.
